CRIMES DE FRONTEIRA E TERRITORIALIDADE:

UM ESTUDO SOBRE A AÇÃO DO ESTADO NA COIBIÇÃO DOS CRIMES DE FRONTEIRA EM SÃO GABRIEL/RS

Abstract

This paper aims to understand the relationship between the principle of territoriality and the action to curb border crimes in the municipality of São Gabriel-RS. In order to achieve the research objective, it is intended to analyze and know the norms related to border law, which regulate the actions of the State in the restraint of crimes typical of the borderland strip. It is also studied how Geography perceives the issue of territoriality, which serves as an indicator to establish the border delimitation of a State. In addition, it is sought to know and describe the typical crimes of the borderland strip provided for in the legislation, identifying the most common crimes committed in the municipality of São Gabriel-RS, in the period from 2015 to 2020. Finally, the actions undertaken by the state agencies present in the municipality to repress border crimes are described. The method of approach to the problem is deductive, because the reasoning starts from a general understanding of what territoriality consists of, its relationship with the normatization of border crimes and the exercise of the police power of the State for actions to curb them. The method of procedure used was the monographic one, which consists of the study of the actions of certain public institutions, seeking to understand how they carry out the combat against the typical border crimes in the period referred to above. This study results in a research similar to the bibliographic and documental, because it uses data without analytical treatment, provided by the public security organs in relation to the researched theme, besides the analysis of the legislation on border law.
